TERMS OF SERVICE

Effective Date: January 1, 2025

These Terms of Service (“Terms”) govern the use of property management services provided by Alpine Property Management Kansas City, LLC (“Company,” “we,” “us,” or “our”). By engaging with our services, you (“User,” “Tenant,” “Property Owner,” or “Client”) acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must refrain from using our services.


1. SCOPE OF SERVICES

Alpine Property Management Kansas City, LLC provides property management services, including but not limited to:

  • Tenant relations and communication
  • Maintenance request coordination and oversight
  • Rental property marketing and leasing administration
  • Rent collection and financial reporting to property owners
  • General property management consulting and support

These services do not include legal representation, financial investment advisory, real estate brokerage services, or tax consulting. Any services beyond the stated scope must be agreed upon in writing by both parties.


2. ACCEPTABLE USE OF SERVICES

You agree to use our services only for lawful purposes. You shall not:

  • Use our services to engage in fraudulent, illegal, or misleading activities.
  • Submit false information, including misleading tenant applications or property listings.
  • Interfere with or disrupt our business operations, website, or communication channels.
  • Harass, abuse, or threaten Alpine Property Management staff, tenants, property owners, or vendors.

We reserve the right to terminate services if you violate these conditions.


3. SMS COMMUNICATION TERMS OF SERVICE

By opting into SMS communications via web forms, lease agreements, rental applications, or any other medium, you provide explicit consent to receive text messages from Alpine Property Management Kansas City, LLC regarding:

  • Appointment scheduling and reminders
  • Maintenance requests and property updates
  • Lease renewal notifications and important tenancy matters
  • Rent payment reminders and billing notifications

Opt-Out & Help Instructions

  • Message Frequency: Message frequency varies; you may receive up to 5 messages per month based on your property management needs.
  • Message and Data Rates: Standard message and data rates may apply.
  • Opting Out: You may opt out at any time by replying “STOP” to any SMS message.
  • Help Requests: Reply “HELP” for assistance or contact our office at (816-343-4520).

4. DATA PRIVACY & COMMUNICATION CONSENT

By utilizing our services, you acknowledge and agree that:

  • Alpine Property Management Kansas City, LLC may contact you via email, phone, or SMS for essential property management functions, including leasing inquiries, maintenance requests, rent collection notices, and legal compliance matters.
  • We do not sell, rent, or share your personal information for third-party marketing purposes.
  • Your information will only be disclosed to authorized personnel, including property owners, maintenance vendors, and service providers, when necessary for property management purposes.
  • We implement commercially reasonable security measures to protect your personal information. However, we cannot guarantee that unauthorized access will never occur.

5. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Alpine Property Management Kansas City, LLC shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
  • Any loss or damage resulting from acts of third parties, including but not limited to tenants, property owners, contractors, vendors, or service providers.
  • Any interruptions, errors, or delays in SMS messaging, email correspondence, or other communication services beyond our control.
  • Any legal disputes between tenants and property owners that do not directly involve Alpine Property Management Kansas City, LLC.

Under no circumstances shall our liability exceed the amount of fees paid to us for property management services within the six months preceding the claim.


6. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Alpine Property Management Kansas City, LLC, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorney’s fees) arising from:

  • Your violation of these Terms or any applicable laws.
  • Your failure to comply with lease agreements, property management policies, or rental obligations.
  • Any disputes between tenants, property owners, or third parties unrelated to Alpine Property Management Kansas City, LLC’s direct actions.

7. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed and construed in accordance with the laws of the State of Missouri, without regard to conflict of law principles.

Dispute Resolution:

  • Any disputes arising from these Terms shall first be attempted to be resolved through mediation.
  • If mediation is unsuccessful, disputes shall be settled exclusively in a court of competent jurisdiction located in Missouri.

8. MODIFICATIONS TO TERMS

Alpine Property Management Kansas City, LLC reserves the right to update or modify these Terms at any time without prior notice. The latest version will always be available on our website. Continued use of our services constitutes acceptance of any revised Terms.
